Tasks and functions

1. Organization and participation in ensuring implementation of the state legal policy in tax and other legislation, control of which is vested at the STS, correct application of legislation at the STS, its territorial directorates, state-owned enterprises and institutions under its management;

2. Organization, planning, coordination and control over the work of the legal support units of the STS territorial directorates;

3. Provision of practical assistance to the legal support units of the STS and its territorial directorates in the organization and conduction of the claim and lawsuit work;

4. Securing assistance in the court cases arising from public service relations; labor disputes; assistance in disputes arising from operations, particularly contracts; in disputes over the non-contractual obligations; in disputes concerning protection of business reputation; in disputes concerning the ownership right or other real right for immovable property; proceedings on execution of court decisions in the listed cases, other cases, excepting cases concerning administration of taxes, fees, payments and also control over the observance of requirements of tax legislation; about bankruptcy;

5. Development and participation in drafting of regulatory acts on issues within the STS competence;

6. Verification of legislative compliance and international treaties of Ukraine of draft regulations, other acts submitted for the Chairman’s signature, their approval (certification) with visas of heads of the interested structural subdivisions;

7. Conduction of legal examination of drafts of normative-legal acts prepared by the STS’s structural subdivisions, on the basis of results of which a conclusion is prepared according to the form approved by the Ministry of Justice of Ukraine, their approval (certification) with visas of heads of the interested structural subdivisions;

8. Revision of normative legal acts and other documents on issues within the Department’s competence jointly with other structural units of the STS, in order to bring them into compliance with the legislation;

9. Generalization (jointly with interested structural units of the STS) of practice on the application of the tax legislation, legislation on the payment of a single compulsory state social insurance (hereinafter referred to as a single contribution) and legislation on other matters controlled by the STS;

10. Consideration of draft regulatory acts and other documents received for approval on issues within the STS competence and preparation of suggestions to them;

11. Approval (certification) of draft contracts with visas of heads of the interested structural subdivisions;

12. Organization of claim work, realization of control over its implementation;

13. Assistance in correct application of the labor law acts in case of non-compliance or violation of their requirements on submission of written opinion with suggestion for the elimination of such violations to the Chairman;

14. Conduction of methodological guidance in legal work at the STS, its territorial directorates, state-owned enterprises and institutions in the sphere of the STS management, continuous monitoring status of the legal work and submission of suggestions to the Chairman for its improvement, elimination of shortcomings in legal support to implementation of new forms and methods of activity of the legal service, implementation of acts of the Ministry of Justice and its territorial departments;

15. Determination of need for legal personnel of the state-owned enterprises and institutions in the STS’s management sphere jointly with interested structural units;

16. Approval of candidates for the positions of heads of subdivisions of STS’s legal support and its territorial directorates, state-owned enterprises and institutions in the STS’s management sphere;

17. Organization and conduction of work related to training of employees of Department, state-owned enterprises and institutions, which are in the sphere of the STS management, clarifying the application of legislation, providing legal advice on matters within the STS competence and review of citizens’ appeals, appeals and requests of the People’s Deputies of Ukraine on behalf of the Chairman;

18. Implementation of measures aimed at raising level of legal knowledge for STS’s employees;

19. Ensuring representation of the STS’s interests in courts and other organizations in the established order.
